According to Article 38, Number 13 of the Organic Law of Human Mobility, the Amparo visa is recognized for children, spouses, or partners in legally recognized de facto unions with the primary visa holder, and cannot exceed that of the primary holder.
Previously, the law provided the protection of siblings and grandparents under a primary visa holder. However with new changes to the law, protection has been restricted to children, spouses, and common-law partners.
A common question we hear regarding this topic is, “what happens in cases when the primary visa holder has passed away?” According to the new Human Mobility Law that went into effect on February 5, 2021 a new article addressing this question was included in the law. Art. 65A. states that, “for cases of temporary and permanent residency visas of Amparo visa holders, in which the primary visa holder has died, the protected foreign person will keep their visa as well as in cases of marriage and de facto union for which these end for causes attributable to the primary visa holder (amparante).” Similarly, the law recognizes the conservation of residence for those cases in which the protected person is naturalized as an Ecuadorian citizen.
Lastly, it is important to remember which documents are required to justify the condition of protection when applying for an Amparo visa, or in the case that the primary visa holder passes away. These include:
