In order to buy real estate in Ecuador it is important to know that the purchase can only be made through a Public Deed granted by sellers and buyers in a Notary’s office in Ecuador. After the purchase-sale deed is granted at the Notary’s Office, it must be entered in the Property Registry so that the purchase is registered in the name of the buyers.
It is necessary to be aware that if you want to buy real estate, a private contract won’t work even if you have witnesses signing with the buyers and sellers since the law establishes that the only valid document that demonstrates an act of purchase and sale of real estate or a vehicle is through a public deed in the case of real estate; and, contract in the case of vehicles, granted in any Notary of Ecuador.

THE REGULATION OF THE HUMAN MOBILITY LAW, which we have waited so long for, is only expected to be published in the Official Registry so that it becomes effective.

When a foreign citizen uses a real estate property as support for his/her temporary visa, this property immediately acquires a prohibition to sell or transfer also known as “prohibition to alienate”, this figure assures that this property will continue to serve as support for as long as the person holds the temporary visa. However, once the foreign citizen has obtained the permanent visa, he/she can request the lifting of the prohibition of alienation to sell, donate, assign or transfer the real estate in any way he/she wishes, since this prohibition will only be in force until the permanent visa is obtained.
In order to carry out the process of lifting the prohibition of alienation it will be necessary to have a “certificate of encumbrances” issued by the property registry of the city, which will later be submitted to the Ministry of Foreign Affairs and Human Mobility so that they, as an authorized Institution, review this request and once it is admitted, order by means of an official letter addressed to the property registrar, the lifting of such prohibition.

A note from Lee Dubs …
Carol and I came to Cuenca in 2004. I tell people that we were among the first gringos in town. I had known Cuenca since my first trip in 1990 to establish an exchange program between the University of Cuenca and my college in North Carolina. One day when Carol and I were in a local bookstore, she confessed to me that she always had a dream of “owning a bookstore with a cat in the corner.”
I agreed in 2005 to give it a try, and we accepted the invitation of the owner of that bookstore to join her. A fire in the upper floors of that building forced us to move in 2007, and we resettled on Hermano Miguel and Calle Larga. I named us the Carolina Bookstore in honor of Carol. We became a gathering spot for gringos and many others. A common farewell in Cuenca was “See you at the bookstore.” Everyone knew which bookstore, which a traveler once called “the Barnes and Noble of South America.”.
As Carol’s health deteriorated, she could no longer leave our apartment and I persuaded her to sell her beloved store in 2016. It survives to this day but without the grandeur of its glory days. Carol died in her sleep on May 21st. She suffered from three major illnesses that conspired to carry her off. Her beautiful heart finally stopped.
